Authority Constrained by Ayaawx

Category: Tsm’syen Law Page status: Working

Purpose

This page affirms that all authority within Tsm’syen governance is constrained by ayaawx. It clarifies that no person, name, role, or governing body holds authority outside of or above the law. Authority exists only where it aligns with responsibility, balance, and proper conduct.

This page does not create authority. It defines its limits.

General principles

  • Ayaawx is the highest authority.
  • All human authority is conditional, not absolute.
  • Names, titles, and roles do not grant unchecked power.
  • Authority must be exercised in accordance with responsibility.
  • When authority departs from ayaawx, it loses legitimacy.
  • Law restrains power; power does not define law.

Authority does not exist independently

Authority does not arise from position, election, or recognition alone.

It exists only through alignment with ayaawx, adaawx, and proper conduct.

A person may hold a name or role, but if their actions violate ayaawx, their authority is not valid in that moment.

Limits on leadership and decision-making

  • Leaders do not act unilaterally where collective responsibility is required.
  • Decisions affecting land, people, or future generations must reflect ayaawx.
  • Authority remains accountable to house, clan, and Nation.
  • No leader may override law for convenience, speed, or external pressure.

Misuse of authority

Authority is misused when it is exercised:

  • For personal gain
  • To silence others or avoid accountability
  • In contradiction to adaawx or witnessed law
  • In service of external systems over Tsm’syen law

Misuse of authority is a breach of ayaawx and creates imbalance requiring correction.

Loss and restoration of authority

When authority is exercised outside ayaawx:

  • Its legitimacy is diminished or lost
  • Actions taken under it may be challenged or set aside
  • Responsibility returns to the proper governing body (house, clan, or Nation)

Restoration of authority requires:

  • Acknowledgment of imbalance
  • Correction of actions
  • Re-alignment with ayaawx through proper process and witnessing

Ayaawx as restraint and protection

Ayaawx protects the people by ensuring:

  • No concentration of unchecked power
  • No external system defines internal authority
  • Leadership remains grounded in responsibility, not control

Ayaawx also protects leaders by providing clear boundaries within which they may act with legitimacy.

Application in modern governance

This principle applies to:

  • Elected leadership
  • Administrative bodies
  • Negotiators and representatives
  • Any person acting on behalf of the Nation

No modern structure replaces or overrides ayaawx. All must operate within it.

Closing principle

Authority is not something a person holds. It is something they are permitted to carry, only for as long as they act in accordance with ayaawx.
