Accountability for Harm

Any person, house, or entity exercising use or access to land or waters is accountable for harm caused through their actions or omissions.

Harm includes, but is not limited to:

  • Physical damage to land or waters
  • Degradation of ecosystems or habitats
  • Contamination or pollution
  • Interference with lawful harvesting or cultural practices
  • Disrespect or violation of Ayaawx obligations

Where harm occurs:

  • Lawful use and access may be immediately questioned, limited, suspended, or revoked
  • Accountability must be addressed through Ayaawx-based processes
  • Restoration, repair, or other remedy is required
  • Continued access is not presumed and must be re-established

Failure to acknowledge or remedy harm constitutes an ongoing violation and may result in the loss of authority to use or access the territory.
